By accessing or using EmoraPath ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services. These Terms apply to all visitors, registered users, and subscribers of EmoraPath.

2. Description of Service

EmoraPath is an AI-powered mental wellness platform that provides informational content, journaling tools, community forums, therapist directories, emotional check-ins, and wellness resources. The Platform is intended for general informational and self-improvement purposes only. EmoraPath is not a licensed medical provider, therapist, or crisis intervention service.

• You must be at least 13 years of age to use EmoraPath.
• Users between 13 and 18 must have parental or guardian consent.
• By creating an account, you confirm that the information you provide is accurate and complete.
• EmoraPath reserves the right to suspend or terminate accounts that violate eligibility requirements.

5. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.
• You may not share your account with others or create multiple accounts for the same person.
• EmoraPath reserves the right to suspend or terminate accounts at its discretion.

6. Subscription Plans & Billing

EmoraPath offers Free, Plus, and Pro subscription tiers. Paid plans are billed on a recurring monthly or annual basis. By subscribing, you authorize EmoraPath to charge your payment method on a recurring basis until you cancel. Subscription fees are non-refundable except where required by law. You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period. EmoraPath reserves the right to change pricing with 30 days' notice.

7. Acceptable Use

You agree not to use EmoraPath to:

• Post or share content that is harmful, abusive, harassing, threatening, or discriminatory.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Upload or transmit viruses, malware, or any other malicious code.
• Attempt to gain unauthorized access to any part of the Platform or its systems.
• Scrape, crawl, or harvest data from the Platform without express written permission.
• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Promote or facilitate self-harm, suicide, or harm to others.
• Spam, solicit, or advertise to other users without authorization.

8. Community Forum Rules

The EmoraPath community forum is a safe space for mental wellness discussion. All users must:

• Be respectful and supportive of other community members at all times.
• Refrain from sharing personal medical advice or diagnosing others.
• Not post graphic, violent, or sexually explicit content.
• Report posts that violate community guidelines using the report feature.
• Understand that forum posts are visible to other registered users.

EmoraPath moderators reserve the right to remove any content that violates these guidelines and to ban users who repeatedly or severely violate community standards.

9. AI Chat & Automated Features

EmoraPath's AI chat and automated wellness tools are powered by artificial intelligence and are provided "as is." AI responses are generated automatically and may not always be accurate, complete, or appropriate for your specific situation. Do not rely on AI-generated content for medical, legal, or financial decisions. EmoraPath is not liable for any harm resulting from reliance on AI-generated content. The AI is not a licensed therapist and cannot replace professional mental health care.

10. Intellectual Property

All content on EmoraPath — including text, graphics, logos, icons, images, audio clips, and software — is the property of EmoraPath or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without express written permission. User-generated content (such as journal entries and forum posts) remains your property; however, by posting on the Platform, you grant EmoraPath a non-exclusive, royalty-free license to display and store that content as necessary to operate the service.

Your use of EmoraPath is also governed by our Privacy Policy, which is incorporated into these Terms by reference. 12. Limitation of Liability

To the fullest extent permitted by law, EmoraPath and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the Platform. This includes, without limitation, damages for loss of data, loss of profits, or emotional distress. EmoraPath's total liability to you for any claim arising from these Terms shall not exceed the amount you paid to EmoraPath in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless EmoraPath and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any third-party rights.

14. Termination

EmoraPath reserves the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.

15. Changes to These Terms

EmoraPath may update these Terms of Service from time to time. We will notify registered users of material changes via email or an in-app notice at least 14 days before the changes take effect. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
